Before diving in, it must be understood that Basalt and the midvalley’s mix of jurisdictions and county lines complicate an already confusing situation. The public health standards for one type of business/industry may not be the same as another, and the different counties will follow different timelines than that of its neighbors or the state. In every scenario – public health departments are making decisions based on the safety of and risk-level to the community in question. In the coming days and weeks what a business can do in Eagle County will likely differ from what a business can do in Pitkin County, or  another part of the state.
 
The transition from Stay At Home to Safer At Home will be different depending on who you are, where you live, and the type of business you operate (or work for). The timing will also vary.

NOTE: On Saturday, May 9, 2020, Pitkin County will  transition to Safer At Home, Phase I. The content below pre-dates that change and is accurate through May 8, 2020. An updated chart will be posted the week of May 11, 2020.

Planning and Preparing for Safer At Home

As each local government releases additional specific details on its public orders, it will be posted on the Chamber’s website and on social media.
 
Social Distancing Requirements is defined as: “for all people not of the same household, maintaining a distance of at least six (6) feet between people. You may not be inside of six feet for longer than ten (10) minutes, should wash hands with soap and water for a least twenty seconds as frequently as possible or using hand sanitizer, covering coughs or sneezes (into the sleeve or elbow, not hands), regularly cleaning high-touch surfaces and not shaking hands.”

Masks

Required for employees if 6 feet distance can’t be maintained beyond the momentary circumstances.

Strongly recommend that community members cover their faces when they enter businesses or whenever 6 feet of distance cannot be maintained for a prolonged period of time (10 minutes or longer) with anyone outside their household.

Letter from the Director of Eagle County Public Health.

Required in Town of Basalt  (Effective May 1-26): When entering and while inside the areas of a place of business open to the public, and in such other public indoor or outdoor places where persons are unable to maintain safe social distancing (e.g. six or more feet separation). Approved Resolution. Places of business open to the public shall not permit entry by persons not in compliance with this Public Health Order.

Required in City of Aspen through May 27.

All persons shall wear Face Coverings: a. when entering and while inside of a place of business open to the public, and b. in such other public indoor or outdoor places where persons are unable to maintain safe social distancing from others not of their own household.

Required in Pitkin County, effective May 9: For all employees in critical business and every member of the public in all public buildings/businesses and outside if you go within 6 feet, or are at risk of going within 6 ft, of another person. NOT necessary if greater than 6 feet from others for no longer than 10 minutes.

All retail establishments may continue to operate by continuing online or over-the-phone sales. Goods ordered must be delivered by mail or by delivery to a customer’s home or vehicle and outside of the retail location.

Hotels, motels, short term rentals (30 days or less), bed and breakfast, lodges and retreats closed except for essential workers and isolation and quarantine needs. There shall be no new bookings or reservations during the pendency of this Order.

Second homeowners Second Home Owners are considered Local Residents in Eagle County.

Non-resident homeowners and their accompanying family, friends and guests returning to their residence after the date of this Order must self-quarantine for a period of fourteen (14) days at their residence in Pitkin County.

Golf courses can remain open for outdoor activities with the submission and approval of a Business Safety plan; however, Social Distancing Requirements must be strictly followed. Clubhouses, restaurants, snack bars and pro shops must not be open and tee times and golf fee transactions made only online. Only household  members may share a golf cart or be a caddy for a golfer. Golfers are strongly encouraged to not touch any equipment that is not their own (e.g. tees and flags).

Enforcement of public health orders

Failure to comply with this order is subject to the penalties contained in Sections 25-1-516 and 18-1.3-501, Colorado revised statutes, including a fine of up to five thousand (5,000) dollars and imprisonment in the county jail for up to eighteen months.

Under Colorado law, counties and local public health agencies have the authority to administer and enforce a public health order. The state is recommending that local law enforcement and/or local public health agencies first reach out to the entity to seek voluntary compliance. However, local county attorneys or district attorneys can bring any civil or criminal action requested by the local public health director for a local violation of an order. A county attorney representing a local public health agency can seek a judge’s order in state court to force an individual or business to immediately comply with an order.
